Brisbane Transport Company Fined 31 5k For Failure To Pay Compensation To Dismissed Worker

The Fair Work Ombudsman (FWO) has given a transport company and its director a fine of $31,550 after it failed to comply with an order to pay compensation to a worker it unfairly dismissed.

 
 

Brisbane-based transport company, Michael Lawler Transport, received a $26,292 penalty, and its sole director, Michael Lawler, received a $5,258 penalty at the Federal Circuit and Family Court – for failing to comply with an order to pay $27,280 in compensation to a worker that it fairly dismissed in July last year.

The employee – a driver – was employed by Michael Lawler Transport between July 2022 and December 2023.

Following the failure to comply, the employee sought assistance from the FWO. It was only after the ombudsman filed legal proceedings this year that the company made any payment on the compensation order.

On top of its penalty, the court ordered the company to pay the worker an outstanding compensation payment of $12,280.

Ombudsman Anna Booth (pictured) said: “It is fundamental for the integrity of the workplace relations system that orders made by the Fair Work Commission are complied with, and we will take legal action to hold employers accountable and ensure employees receive compensation.

“The total penalties in this case – exceeding the original compensation order – highlight what is at stake when respondents fail to act on commission orders.

“Any employees with concerns about their pay or entitlements should contact us for free advice and assistance.”
